This Privacy Policy (the “Privacy Policy”) tells individuals who access the mondato.com website (“Users”), sign up for the Mondato newsletter (“Newsletter”) through a service provider, register for access to the Free Reports and/or Webinars, make a Speaker Request, apply for a Job Posting and/or purchase Premium Content, what information about such individuals (“Information”) Mondato LLC (“Mondato” or “we”) or its service providers collect as part of their interaction with the mondato.com website (the “Website”) and their participation in the newsletter subscription process, in the Free Report and Webinar accessing process, in the application process for a Job Posting, in the process for making a Speaker Request and the Premium Content purchasing process, and how that Information is used, shared, and protected.

This Policy concerns only this Website, and does not concern any other website, including websites to which this Website may link. If you do not wish Mondato to collect, use, share and protect your Information consistent with this Privacy Policy, immediately discontinue your access to and use of this Website and do not return.

Please note that this Privacy Policy is subject to the Mondato Terms of Use of the Website and the Terms and Conditions for Premium Content. Except as otherwise provided, terms defined in the Mondato Terms of Use of the Website, and the Terms and Conditions for Premium Content have the same meaning in this Privacy Policy. If there is a conflict between the Mondato Terms of Use of the Website and this Privacy Policy, this Privacy Policy shall prevail. If there is a conflict between Terms and Conditions for Premium Content and this Privacy Policy, this Privacy Policy shall prevail.

Please also note that there are special provisions for those Users who register for the Newsletter (“Newsletter Users”), who purchase Premium Content (“Purchasers”), who register for Free Reports (“Downloaders”), who post and/or contribute Contents to the Interactive Areas (“Interactive Area Users”), who access Webinars (“Webinar Users”), who make a Speaker Request (“Speaker Requesters”), who apply for a Job Posting (“Job Applicants”), or who share Articles with third parties (“Article Sharers”). The additional Information that is provided by the Newsletter Users, Purchasers, Downloaders, Interactive Area Users, Webinar Users, Speaker Requesters, Job Applicants and Article Sharers in those instances is governed by the specific clauses in this Privacy Policy concerning the Newsletter, the Premium Content, the Free Reports, the Interactive Areas, the Webinars, the Speaker Requests, the Job Posting and the Articles. These particular provisions are accepted by the Newsletter Users when they register for the Newsletter, by the Purchasers when they purchase the Premium Content, by the Downloaders when they download a Free Report, by the Interactive Area Users when they post and/or contribute Contents to the Interactive Areas, by the Webinar Users when they register to access the Webinar, by the Speaker Requesters when they make a request for a Speaker, by the Job Applicants when they submit an application, and by the Article Sharers when they share an Article with a third party for the first time.

 

International Transfer

Mondato’s data processor is The Rocket Science Group LLC d/b/a MailChimp, which is an active participant in both the Swiss-U.S. Privacy Shield Framework and the EU-U.S. Privacy Shield Framework, as recorded here. Thus, our legal basis for transferring data internationally is our Data Processing Agreement with MailChimp.

Your information may be transferred to - and maintained on - computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Mondato transfers personal information to the United States and processes it there. your consent to this privacy policy followed by your submission of such information represents your agreement to that transfer.

 

How Mondato collects Information about its Users

When a User visits the Website, Mondato collects the person’s IP address and standard web browser information, such as browser type and the pages accessed on the Website, for statistical and analytical purposes. If the User visits from a mobile phone or other access device, Mondato collects in addition device identifiers, their country location and mobile network information. This information is collected on an aggregate and non-individual specific basis. This information may also be used in order for Mondato and/or third party service providers to improve the User experience, such as by displaying targeted on-line advertisements on the Website, and for fraud prevention purposes.

 

How Mondato collects information about its Newsletter Users, Purchasers, Downloaders, Webinar Users, Interactive Area Users, Speaker Requesters, Job Applicants and Article Sharers

When a User requests a service (i.e., Newsletter, Premium Content, Free Report, Webinar, etc.), Mondato does not tie consent to one service to consent to another. For instance, providing Mondato your email to download Premium Content will not subscribe you to the Newsletter. Keep this in mind while reviewing the information that Mondato collects on Users for the following services:

If a User registers as a Newsletter User, Mondato only collects, via MailChimp, the User’s name, the User’s email address, the company for which he/she is currently employed, the User’s company position, the User’s industry, the User’s country, how the User heard of Mondato, the User’s Newsletter interest preferences and whether the User wishes to receive promotions and updates from Mondato and third parties.

If a User purchases Premium Content, Mondato only collects the User ‘s name, the User’s email address, whether the User’s billing address is in the District of Columbia, the User’s billing address zip code, a credit or debit card number, the cardholder name, the expiry date of the credit or debit card, the card type and the cvc from the User. Mondato only stores a User’s name, email address, and zip code (if applicable). The stored information is not sufficient to make a charge against the credit or debit card, and is stored only for accounting purposes.

If a User registers to download a Free Report via the Website, Mondato only collects and stores the User’s name, role, industry, company and email address from the User.

If a User registers to access a Webinar on the Website, Mondato collects only the User’s name, the User’s e-mail address, the company for which the User is currently employed, the User’s role, and whether the User wishes to receive the Mondato Newsletter, from the User.

If a User posts and/ or contributes Contents to the Interactive Area of the Website, Mondato collects only the Content, the User’s name and the User’s email address, from the User.

If a User makes a Speaker Request, Mondato collects only the User’s name, the User's e-mail address, the User’s telephone number, the details of the User’s event (including name, dates, website and topic) and the suggested topic of the speech, from the User.

If a User applies to a Job Posting, Mondato collects, via Indeed, the User’s name, the User’s e-mail address, the User’s phone number, the User’s work history, the User’s education, a copy of the User’s resume, the User’s cover letter and the User’s response to our application questionnaire, from the User.

If a User sends copies of Articles to a third party via email though MailChimp, Mondato only collects the User’s e-mail address and the destined recipient’s e-mail address from the User.

 

How Mondato uses cookies

When the User accesses the Website, Mondato, or companies hired by Mondato to track how the Website is used, may place small data files called "cookies" on the User’s computer.

Mondato encodes its cookies so that only Mondato can interpret the information stored in them. A User is free to decline cookies if his/her browser permits, but doing so may interfere with use of the Website.

 

Web Beacons

The Website may contain electronic images known as Web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how the Website is used.

 

How Mondato protects and stores Information

Throughout this policy, the term "Information" is used to describe non-public information that can be associated with a specific person and can be used to identify that person. Information does not include information that has been anonymized so that it does not identify a specific user.

Mondato stores and processes Information on its servers in the United States and Mondato protects it by maintaining physical, electronic and procedural safeguards in compliance with applicable legislative and regulatory standards. Mondato uses computer safeguards such as firewalls and data encryption and authorizes access to Information only for those employees who require it to fulfill their job responsibilities.

Mondato uses up-to-date technologies and maintains rigorous security standards and procedures with a view to preventing unauthorized access to all Information. However, messages and information passing over the Internet may not be secure and can be intercepted by third parties or incorrectly delivered. The confidentiality of such communications cannot, therefore, be guaranteed and a User should not divulge personal information over the Internet unless he/she is using a secure or encrypted communications technology.

 

How Mondato uses the Information collected

Mondato collects Information to provide the User with a secure, seamless and simple user experience and to comply with all legal regulations. Mondato does not use personal information to make automated decisions. All Information will be treated by Mondato with the utmost confidentiality. The lawful basis for this processing is that in each case Mondato gathers consent from the User to process their personal data for one or more specific purposes. Mondato will store Information until that Information is no longer relevant to the original service provided. For instance, if we decide to stop sending the Newsletter, we will stop storing Information on Users who provided us their Information for the purpose of subscribing to the Newsletter. Mondato uses Information to:

  • enable a User to post Content to Interactive Areas;
  • enable the User to apply for a Job Posting;
  • enable the User to make a Speaker Request;
  • allow the User to read content on the Website, including the Articles;
  • provide the User access to recorded Webinars on the Website;
  • enable the User to send copies of Articles to third parties via email or via third party social media plug-ins;
  • provide the User with the Newsletter;
  • provide the User with Premium Content if purchased;
  • provide the User with a Free Report if requested;
  • resolve disputes and troubleshoot problems;
  • monitor potentially prohibited or illegal activities and enforce the Terms of Use of the Website and the Terms and Conditions for Premium Content;
  • customize, measure, and improve the content and layout of the Website, including the display of customized, targeted marketing and promotional offers on the Website (if relevant);
  • customize, measure, and improve the Newsletter, Webinars, Articles, Premium Content and Free Reports, including the display of customized, targeted marketing and promotional offers in the Newsletter where the User has consented to the use of Information for these purposes;
  • send the User targeted marketing and promotional offers where the User has consented to the use of Information for these purposes;
  • send Newsletter Users information in regards to matters that are relevant to them as Newsletter Users (such as service and Newsletter update notices); and
  • compare information for accuracy and verify it with third parties.
 

How Mondato shares Information with other parties

When sharing Information with other parties, Mondato ensures that all sharing is only with the express and separate consent of the User. Mondato may share Information with:

  • Members of the Mondato corporate family to help detect and prevent potentially illegal acts, provide joint service offerings and for other business purposes. However, these corporate affiliates will not use this Information to market their services unless approved by the User.
  • Service providers under contract who assist with parts of the Mondato business operations including marketing and technology services, including MailChimp in regards to Newsletter distribution and Indeed in regards to the Job Postings. Pursuant to Mondato’s Terms of Use of the Website, these service providers only use Information in connection with the services they perform for Mondato and not for their own benefit.
  • Third party service providers and other independent contractors that Mondato partners with that allow the User to click through from the Website to such third party’s website in order to facilitate the sharing of Articles. In this case Mondato will only provide the data inputted by the User, namely the shared Articles and the User’s IP address. This data will be held by the third party provider for the purposes set out in that third party provider's privacy policy. Users are strongly advised to read the chosen third party provider's privacy policy and satisfy themselves as to the purposes for which the third party provider will use the User’s Information before sharing Articles. Mondato has no responsibility for the uses to which a third party provider puts a User’s Information once the User has used the third party plug-in.
  • Third party service providers including financial institutions and other independent contractors that Mondato partners with that allow the User to purchase Premium Content, including Stripe (https://stripe.com/), which processes Mondato’s credit card and debit card transactions. In this case Mondato will only provide the data inputted by the User in his/her purchase request to Stripe or any other third party provider, and the User hereby expressly consents to Mondato disclosing such Information to Stripe or any other third party provider. Further, Stripe or a third party provider may collect Information directly from Users via cookies or other means. The User hereby expressly consents to Stripe or a third party provider collecting, using, retaining and disclosing this Information. This data will be held by Stripe or any other third party provider only for the purpose of affecting the purchase as set out in Stripe’s, or that third party provider's privacy policy. Users are strongly advised to read the chosen third party provider's privacy policy.
  • Companies that Mondato plans to merge with or be acquired by. (Should such a combination occur, Mondato shall require that the new combined entity follow this Privacy Policy with respect to Information.)
  • Law enforcement, government officials, or other third parties when
    • Mondato is compelled to do so by a subpoena, a court order or a similar legal procedure
    • Mondato is required to do so to comply with the law
    • Mondato believes in good faith that the disclosure of Information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of the Mondato’s Terms of Use of Website and The Terms and Conditions for Premium Content
  • Other third parties with the User’s consent.
  • Mondato will not sell or rent any of a User’s Information to third parties in the normal course of doing business and only shares Information with third parties as described in this policy.
 

Accessing or changing Information and contacting Mondato

A User has the right to request the following from Mondato:

  • A copy of all Information relating to him/her held by Mondato;
  • Whether or not personal data is being processed;
  • The purposes of the processing;
  • The categories of data concerned;
  • The recipients to whom the data have been or will be disclosed;
  • The period for which the personal data will be stored;
  • To have any inaccurate information rectified or erased, including any Contents that that he/she has posted or contributed to the Interactive Areas;
  • To have personal data taken off a direct marketing or direct mailing list.

Because we are not a public authority and our core operations do not require regular and systematic monitoring of data subjects on a large scale, we have not designated a specific data protection officer.

If Newsletter Users wish to unsubscribe from the Newsletter, they may do so by clicking on the “unsubscribe” hyperlink found on the bottom of each Newsletter and following the procedure indicated, in which case Mondato will remove the Newsletter User’s email address from its Newsletter database within 48 hours upon receipt of such notice from the Newsletter User.

Users also have the right to lodge a complaint with a supervisory authority regarding Mondato’s data processing.
